Terms of Service
Effective
These terms are the agreement between you and us about using Yenza. They are written to be read, not to be survived.
1. Who you are agreeing with
Yenza is operated by YenzaNow (Pty) Ltd (registration number 2026/756315/07), a company registered in Johannesburg, South Africa. Our registered address is on the public companies register at CIPC, and we will give it to you in writing on request at hello@yenzanow.com. “We” and “us” mean that company. “You” means the person using Yenza and the business they use it for.
By creating an account you agree to these terms. If you are agreeing for a business, you confirm you are allowed to bind it.
2. What Yenza does
Yenza learns about your business and uses AI to produce marketing campaigns — creative, copy, and, where you ask for it, advertising placed on platforms such as Meta and Google. You review what it produces. Nothing is published to an advertising platform unless you explicitly decide to run it.
3. Your account
You must be 18 or older and give us accurate information. You are responsible for activity under your account, so keep your sign-in secure and tell us promptly at support@yenzanow.com if you think someone else has access.
4. What you upload, and what we make
Your content stays yours. Photographs, logos, text and business information you upload remain your property. You give us the licence we need to store that content, process it, and generate campaigns from it — that licence exists only to operate the service for you, and it ends when you delete the content or close your account.
What Yenza generates for you is yours to use for your own marketing, once your account is in good standing. We may keep using it internally to improve the service.
By uploading, you confirm that:
- you own the content, or have permission to use it;
- anyone identifiable in a photograph has agreed to appear in advertising for your business; and
- the content is lawful and not misleading.
5. Things you may not do
- Break the law, or use Yenza to help someone else break it.
- Advertise anything you may not lawfully advertise, or anything the advertising platforms prohibit.
- Upload someone else’s content without permission.
- Try to break, overload, reverse-engineer or gain unauthorised access to Yenza.
- Resell or white-label Yenza without our written agreement.
6. AI-generated output — read this part
Yenza uses AI, and AI makes mistakes. Generated copy and imagery may be inaccurate, unsuitable, or wrong about your business.
You are the publisher. You review each campaign before it runs, and you are responsible for what goes out under your business’s name — including whether every claim in it is true. Yenza is built not to invent commercial facts such as prices, guarantees or stock levels, but you must still check. If something is wrong, do not run it.
Similar businesses may receive similar creative. We do not promise that anything generated for you is unique.
7. Advertising, budgets and third-party platforms
Where you instruct us to run advertising, you authorise us to create and manage campaigns on those platforms on your behalf, within the budget you set. Those platforms have their own terms and their own policies, and they may reject or remove an advertisement for reasons outside our control.
We do not promise advertising results. Nobody honestly can. We do not guarantee any level of impressions, clicks, leads, sales or return on your spend.
8. Fees
Charges for Yenza, and for any advertising budget you commit, are the amounts shown to you in the product at the time you agree to them. We will always show you what something costs before you pay for it. Advertising spend is separate from any fee for using Yenza, and is set by you.
9. Stopping
You can close your account whenever you like. We may suspend or close an account that breaches these terms, or where we are required to. If we do that without cause, we will refund anything you have paid for services not yet delivered.
10. Availability
We work to keep Yenza running, but we do not promise it will be uninterrupted or error-free. We may change or discontinue features. If we make a material change that disadvantages you, we will tell you.
11. Liability
Nothing in these terms limits liability that cannot lawfully be limited — including under the Consumer Protection Act 68 of 2008 where it applies to you.
Subject to that: we are not liable for indirect or consequential loss, lost profits, lost revenue or lost business opportunity. Our total liability to you for any claim is limited to the amount you paid us for the service in the three months before the claim arose.
We are not liable for the performance of advertising, for decisions an advertising platform makes, or for content you chose to publish.
12. Indemnity
If someone brings a claim against us because of content you uploaded or published through Yenza — including a claim that it infringes their rights or misled someone — you will cover our reasonable costs of dealing with it.
13. Changes to these terms
We may update these terms. We will change the effective date above and, for material changes, tell you directly. Continuing to use Yenza after a change means you accept it.
14. Law and disputes
These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction. Before going to court, please email support@yenzanow.com — most things are faster to fix than to litigate.
15. Privacy
How we handle personal information is set out in our Privacy Policy, which forms part of these terms.
